Contract of Enrollment -- Terms and Conditions

This document is a contract entered into and agreed upon between Nutrition Innovators, Inc., a Louisiana Corporation,
herein referred to as "Camp" and the Parent(s) or Guardian of the Camper identified above.  As used in this contract,
the term "Camp" shall additionally include the Camp's directors and employees (including the Camp's staff).  Parent(s)
/Guardian, for and in consideration of the agreement on behalf of the Camp to accept the Camper identified above for
the Camp session referenced above, hereby agree to all of the terms and conditions stated below.

  1. This contract constitutes the full understanding of the parties hereto and no change, modification or waiver of any of
    the terms hereof shall be effective unless in writing and signed by both parties.
  2. In consideration of Camper's enrollment and payment of the appropriate fees, Nutrition Innovators, Inc., Summer
    Camp Program, agrees to provide a regular camp program of instruction, and supervision. Fees do not include
    transportation to and from the Camp.  All physicians'  fees, hospital fees, medicines and any other medical
    expenses, that may be necessary, are the responsibility of the Camper's family.  
  3. Parent(s)/Guardian agrees that the Camper identified above may participate in any activity organized by the Camp
    staff, including swimming and hiking and others. Parents(s)/Guardian assume the inherent risk of such activities
    and will hold Nutrition Innovators, Inc., harmless in the event of any injuries, medical bills or property damage that
    may result from a Camp activity.
  4. Parent(s) agree to pay a Total Fee of $200.00 for one week of the 2008 Summer Day Camp Program as follows:  
    Registration Fee of $15.00 and a Camp Fee of $185.00, payable upon registration..
  5. No adjustment, allowance or refund of the deposit or balance of the registration or Camp fees shall be made except
    in strict conformity with the following rules:
  • If cancellation is due to non-payment of fees, all money received by Nutrition Innovators, Inc., will liquidate the
    damages.
  1. For the safety, welfare and proper maintenance of all the Campers, Nutrition Innovators, Inc., reserves the
    unrestricted right to terminate any Camper's session and immediately dismiss the Camper for behavior deemed
    unacceptable by the Camp Director.  Such conduct shall include, but is not limited to:  The use or possession of
    weapons, drugs or drug paraphernalia, stimulants or intoxicating beverages, leaving Camp grounds, leaving Camp
    activities at any time without official approval and supervision, damaging or defacing of Camp property, smoking,
    possession of cigarettes, refusing to participate in Camp activities, not complying with Camp rules and procedures,
    inappropriate  intimate behavior, and omission or misrepresentation regarding medical or mental history of the
    Camper.  Nutrition Innovators, Inc., does not assume a legal obligation to administer prescription medications and
    failure to do so does not excuse the Camper from following rules or appropriate behavior.  Any of the above conduct
    may subject the Camper to dismissal and Parent(s)/Guardian must pick up the Camper in a reasonable time
    period. In such event, there will be no refund or adjustment of any part of the Camp fees.  Nutrition Innovators, Inc., is
    not responsible for Campers when traveling to and from the Camp.  
  2. Due to the seasonal nature of summer camping, there is no refund or credit for any portion of the camping period
    not completed including late arrival, early departure, dismissal for cause, illness or accident, disability or withdrawal
    for any reason.  Nutrition Innovators, Inc., does not screen Campers for admission.  The guidance staff does not
    offer psychotherapy.  The Parent(s)/Guardian hereby agree that there is a risk that their Camper may not complete
    the session and in that event, assume full financial loss.  Tuition and fees already paid and/or due are agreed to be
    fair and reasonable for liquidated damages.  All claims for refund or credit are expressly waived and released by
    Parent(s)/Guardian.  
  3. The venue and place of trial of any dispute that may arise out of this agreement, or otherwise, to which Nutrition
    Innovators, Inc., or its agents, is a party, shall be in the City of Lafayette, Parish of Lafayette, State of Louisiana.  In
    the event that Nutrition Innovators, Inc., retains the services of an attorney to enforce the rights under the terms of this
    contract, if successful whether after litigation or through settlement, Nutrition Innovators, Inc., shall be entitled to
    reimbursement for its legal fees and costs.  In the event that any portion of this agreement is deemed void or
    unenforceable for any reason, it shall not affect the balance of the agreement which shall be enforced in the manner
    designed to give Nutrition Innovators, Inc., the fullest benefit and protection represented by this agreement.
  4. Nutrition Innovators, Inc., its officers, directors, and employees, shall not be responsible for clothing, laundry,
    baggage, packages or personal possessions lost or damaged by fire, theft, malicious mischief or personal
    negligence.  
  5. The undersigned hereby give permission to the physician or hospital selected by the Camp to hospitalize, secure
    proper treatment for, and to order injection, anesthesia, medicine, x-ray, surgery or any other medical treatment for
    the child named above and to use Camper's insurance coverage to pay for these services.
  6. Permission is hereby granted to Nutrition Innovators, Inc., to use any photographs, film, video or audio of the above
    named Camper in any public release, publicity, TV program,  advertisement, brochure, website, or promotional
    video.  
  7. Names and addresses of Campers and staff, Camper inquiries and printed material and procedures are
    confidential property of Nutrition Innovators, Inc.
  8. In the event Parent(s)/Guardian decides to withdraw his/her child from Camp, Nutrition Innovators, Inc., requires Two
    (2) hours notice.  Nutrition Innovators, Inc., is not responsible for the camper after departure from Camp property,
    including when transportation agreements are made by the Camp, by Parent(s)/Guardian request.  
  9. Nutrition Innovators, Inc., assumes no responsibility for the acts committed by Camper(s) when
    Camper(s) are in violation of Camp rules, or local, state or federal laws.  Nutrition Innovators, Inc., is
    not responsible for losses of personal property due to acts of Camper(s) or other persons while off
    Camp premises.
